USER AGREEMENT

• Every booking made on Jagadish Tours is subject to cancellation charges levied by the airline, which may vary by flight and booking class.
• Some booked fares may be non-refundable per the specific airline's policy.
• Convenience fee is non-refundable in case of ticket cancellation by the user, or flight cancellation by the airline.
• Online cancellations: Cancellations can be made online by signing in to your Jagadish Tours Account. Step by step details for online cancellations.
• Offline cancellations: We also accept cancellation requests through phone. However Jagadish Tours cancellation charges for such offline cancellations may be higher
• Jagadish Tours cancellation charges: Over and above the airline cancellation charges, Jagadish Tours will levy Rs 300 per passenger per segment for each cancellation
• Only cancellation requests made online or telephonic through our customer support shall be entertained. Jagadish Tours shall not be liable to entertain any cancellation requests made through any other medium including but not limited to sms, e-mail
• For e-tickets, if your cancellation request is made less than 3 hours before departure, you'll need to contact the airline directly to get your reservation cancelled
• If you have done a 'Web/Tele Check-in' with the airline, get in touch with the airline for cancellation. Jagadish Tours will not be able to process the refund for the same and will not take any responsibility for the same.
• Convenience fee charged at the time of booking is non-refundable.
• For any cancellation made by you for which refund is already processed and if it is found that you have used/made changes to the ticket on the same PNR directly with the airline, Jagadish Tours reserves the right to debit your original mode of payment against the amount which has been refunded to you.

• It is mandatory to contact Jagadish Tours for all refunds, as the airline will not be able to refund your tickets booked at Jagadishtours.com
• If you need a refund for paper tickets, please send them back to us. Your tickets must reach us within 48 hours of the time of cancellation so that we can get them endorsed by the airline for you.
• If your paper ticket gets lost or damaged, the airline will not be able to process a refund request.
• All cancellations made directly with the Airline need to be intimated to Jagadish Tours by Email or Phone in order to initiate the refunds process
• Processing times for cancellation and refund requests vary.
• Jagadish Tours shall refund your cancellation only after the respective Airline/Service Provider processes to us your eligible refund.

This web site (the “Site”) is published and maintained by Jagadish Air Travels Pvt Ltd (Jagadish Tours.com), a company incorporated and existing in accordance with the laws of the Republic of India. When you access, browse or use this Site you accept, without limitation or qualification, the terms and conditions set forth below. When you access any sub-site (whether belonging to an ‘associate’ of Jagadish Tours.com or otherwise) through this site, then such sub-site may have its own terms and conditions of use which is specific to such sub-site. Sub-sites may contain such additional terms and conditions of use as may be set out in such sub-site.

These Terms and Conditions of Use and any additional terms posted on this Site together constitute the entire agreement between Jagadish Tours.com / Jagadish Air Travels Pvt Ltd and you with respect to your use of this Site.

The User hereby consents, expresses and agrees that he has read and fully understands the Privacy Policy of Jagadish Tours.com The User further consents that the terms and contents of such Privacy Policy are acceptable to him.

The user agreement incorporates the terms and conditions for Jagadish Tours.com to provide services to the User of this website (”the User”) and any person(s) availing services from Jagadish Tours.com through this website shall be deemed to have read, understood and expressly accepted these terms and conditions, which shall govern the desired transaction or provision of such services by Jagadish Tours.com for all purposes, and shall be binding on the User. Any default on part of the User would vitiate this agreement and shall disentitle the User from availing the services from Jagadish Tours.com. In case Jagadish Tours.com discovers or has reasons to believe at any time during or after receiving a request for services from the User that the request for services is either unauthorized or the information provided by the User or any of them is not correct or that any fact has been misrepresented by him, Jagadish Tours.com in its sole discretion shall have the unrestricted right to take any steps against the User(s), including cancellation of the bookings, etc. without any prior intimation to the User. In such an event, Jagadish Tours.com shall not be responsible or liable for any loss or damage that may be caused to the User or any of them as a consequence of such cancellation of booking or services. The User unequivocally indemnifies Jagadish Tours.com of any such claim or liability and shall not hold Jagadish Tours.com responsible for any loss or damage arising out of measures taken by Jagadish Tours.com for safeguarding its own interest and that of its genuine customers.

Jagadish Tours.com has endeavored to ensure that all the information provided by it is correct, but Jagadish Tours.com neither warrants nor makes any representations regarding the quality, accuracy or completeness of any data or information. Jagadish Tours.com makes no warranty, express or implied, concerning the website and/or its contents and disclaims all warranties of fitness for a particular purpose and warranties of merchantability in respect of services, including any liability, responsibility or any other claim, whatsoever, in respect of any loss, whether direct or consequential, to any user or any other person, arising out of or from the use of any such information.

Jagadish Tours.com reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. Jagadish Tours.com further reserves the right to alter any and all fees from time to time, without notice.

The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.

In case, there is a short charging by Jagadish Tours.com for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.

To the extent Jagadish Tours.com acts only as a booking agent on behalf of third party service providers, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the service providers. In no circumstances shall Jagadish Tours.com be liable for the services provided by the service provider.

Jagadish Tours.com is responsible only for the transactions that are done by the User through Jagadish Tours.com. Jagadish Tours.com will not be responsible for screening, censoring or otherwise controlling transactions, including whether the transaction is legal and valid as per the laws of the land of the User. The User warrants that they will abide by all such additional procedures and guidelines, as modified from time to time, in connection with the use of the services. The User further warrants that they will comply with all applicable laws and regulations regarding use of the services with respect to the jurisdiction concerned for each transaction.

In the event that any of the terms, conditions, and notices contained herein conflict with the Additional Terms or other terms and guidelines contained within any particular Jagadish Tours.com website, then these terms shall control.

However, the User agrees and accepts that in exceptional situations due to any technical or other failure, services committed earlier may not be provided or may involve substantial deficiency. In such cases, Jagadish Tours.com shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of Jagadish Tours.com against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the User.

Without prejudice to whatever is stated above, the maximum liability on part of Jagadish Tours.com arising under any circumstances, in respect of any services offered on the site, shall be limited to the refund of total amount received from the customer for availing the services less any cancellation, refund or others charges, as may be applicable. In no case the liability shall include any consequential loss, damage or additional expense whatsoever beyond the amount charged by Jagadish Tours.com for its services.

In no event shall Jagadish Tours.com and/or its suppliers be liable for any direct, indirect, punitive, incidental, special, consequential damages or any damages whatsoever including, without limitation, damages for loss of use, data or profits, arising out of or in any way connected with the use or performance of the Jagadish Tours.com website(s). The customer is aware that Jagadish Tours.com provides various services like hotel bookings, car rentals, holidays and would like to learn about them, to enhance his / her travel experience.

The customer hereby specifically authorizes Jagadish Tours.com to contact the user with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case that the customer chooses not to be contacted, he / shall write to Jagadish Tours.com for specific exclusion.

Jagadish Tours.com may provide the User with contents such as sound, photographs, graphics, video or other material contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws. The User may use this material only as expressly authorized by Jagadish Tours.com and shall not copy, transmit or create derivative works of such material without express authorization.

The User acknowledges and agrees that he/she shall not upload, post, reproduce, or distribute any content on or through the Services that is protected by copyright or other proprietary right of a third party, without obtaining the permission of the owner of such right. Any copyrighted or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the User to personal liability or criminal prosecution.

The User agrees to indemnify, defend and hold harmless Jagadish Tours.com and/or its affiliates, partner websites and their respective lawful successors and assigns from and against any and all losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by Jagadish Tours.com and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by the User pursuant to this agreement.

You may travel to certain destinations which involve greater risks than others, entirely at your risk as to cost and consequences.

Jagadish Tours.com requests you to consult your local authorities and evaluate travel prohibitions, warning, announcements, and advisories issued by them before booking travel to certain international destinations.

By offering for sale travel to particular international destinations, Jagadish Tours.com does not represent or warrant that travel to such point is advisable or without risk. Jagadish Tours.com does not accept liability for damages, losses, or delays that may result from improper documents for entry, exit, length of stay, or from travel to such destinations.

Jagadish Tours.com reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any material posted herein, in any respect.Jagadish Tours.com shall have no obligation to take the needs of any User into consideration in connection therewith.

You will have to limit yourself as per normal baggage policy of the airlines in the respective class that you have chosen to fly. Any excess baggage that you carry shall remain your responsibility. Any loss of baggage by the airlines or the passenger will be the sole responsibility of the airline and the passenger. Normally economy class 10-20kgs is permitted however if you are traveling to US/ Canada you are permitted to carry 2 pieces as check in and 1 piece as cabin baggage. You are requested to kindly refer to the baggage rules of the individual airlines as the same gets updated from time to time. It is advisable that the passenger acquires adequate insurance cover to secure their life health and property. You can purchase the same from our site. Your health and good life is of utmost importance to us.

Jagadish Tours.com reserves the right to determine the amount of refund value incase of cancellation and amendments. The decision on the quantum of refund will be final as that made by Jagadish Tours.com. The refund will be made in the name of the client. Incase you have booked through Jagadish Tours.com website still we will make the refund in the passengers name. It will take at least 45 days to process refunds for all services. There will be no refund for unutilised services unless specified. All cancellation and amendment charges will be applicable as per principles policies on which Jagadish Tours.com has no control and you will be subjected to it.

a. Hotels: While booking a hotel on our site please carefully go through the fact sheet in details to ensure that the amenities present are as per your requirement. Jagadish Tours.com generally updates all these fact sheets however it is dependent on the hotel to provide updated information. Renovation at hotels is normally undertaken at sole discretion of hotels and not necessarily is informed to us. Incase of any dispute Jagadish Tours.com shall not be liable for a disruption in information.

b. Sightseeing: You have a choice of seat in coach sightseeing and private sightseeing tours. Please choose the same carefully. Panoramic tours do not allow you to stop at the site of the attractions. You will have to follow a schedule. Entrances to attractions are not included in city tours unless specified.

c. Airlines: You have a choice of full service and low cost airline options. Low cost airlines do not have all services available on board hence please choose the airlines carefully before booking. Kindly go through the fare rules and also select your class of travel. There are paper tickets and/or e-tickets that will be provided to you. Both are valid to travel by the airlines. However certain airlines do not entertain e-tickets. In such cases you will be issued paper tickets. We are only an intermediary party hence cannot be held responsible for any delay or cancellation of flight or change of route – a decision taken by the airline. You will be subject to all terms and conditions as per the airlines.

d. Holidays: Please refer to inclusions and exclusions carefully before booking. You can customize your holiday completely on our site if our packages do not meet your requirements.

Jagadish Tours.com is a travel and holiday organizer. We do not control or operate any airline, neither do we control or own any shipping company hotel or transport or any other facility or service mentioned on the site. We take care in selecting all the principles however but because we select them- we have no control on running them. We cannot be held responsible for any lack of service by any independent agency airline transport hotel or any other service provider.

If any provision of this agreement is determined to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect.

This agreement and each user agreement /terms of service shall be governed by and constructed in accordance with the laws of India without reference to conflict of laws principles and disputes arising in relation hereto shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka State in India.
